Terms of Service

1. What Creator Grader Is

Creator Grader is a video scoring tool that analyzes creator video content against the CLEAR-5 framework and returns a 0–100 Brand-Ready Score plus AI-generated feedback. Depending on the version you use, it also returns a paid-media readiness assessment, shown as an Ad Readiness checklist in the iOS app and as a Paid-Ready Score on the web. The service is operated by Allegro Park Technologies LLC, a New York limited liability company ("Creator Grader," "we," "us," or "our").

Creator Grader is an educational and coaching tool, not a professional marketing, legal, compliance, or advertising advisory service. Its scores apply a craft rubric designed by a brand-marketing professional with over ten years of experience in paid social and brand building, executed by an AI model. Scores and feedback are subjective coaching opinions intended to help you improve your content. They are not predictions, and they do not guarantee any outcome, including views, engagement, follower growth, gifts, brand partnerships, or revenue. They are not a substitute for qualified human judgment. See Section 9 for the full disclaimer.

2. Eligibility

You must be at least 13 years old to create an account. You must be at least 18 years old to purchase a paid subscription. By using Creator Grader, you represent that you meet these requirements.

If you are accessing Creator Grader on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3. Your Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at support@allegroparktechnologies.com if you believe your account has been compromised.

You may not share your account with others or use another person's account without their permission.

4. Content You Upload

You retain full ownership of the video content you upload. By uploading a video, you grant Creator Grader a limited, non-exclusive, royalty-free license to process and analyze that content solely for the purpose of providing you with a score and feedback. This license lasts only as long as you keep the grade. It ends when you delete the grade or your account, at which point the video file is deleted from our systems.

You represent and warrant that:

• You own or have the rights to upload the content.
• The content does not infringe any third party's intellectual property rights.
• The content does not violate any applicable law.
• You are not uploading content on behalf of your current employer using employer-confidential materials.

Important: uploaded videos are stored in Google Cloud Storage and analyzed by Google's Gemini models on Vertex AI. By uploading a video, you acknowledge and consent to this storage and transmission. See our Privacy Policy for details.

We do not use your uploaded video content to train AI models, sell to third parties, or share with other users. We may re-run a retained video to test and calibrate a change to our scoring rubric, and we may use de-identified, aggregated grade data for the same purpose. Neither trains or fine-tunes an AI model. See our Privacy Policy for details.

5. Acceptable Use

You may not use Creator Grader to:

• Upload content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Upload content depicting minors in sexualized or exploitative situations.
• Attempt to reverse-engineer, copy, or replicate the CLEAR-5 scoring framework or any proprietary scoring logic.
• Use automated tools or scripts to submit grades in bulk without prior written permission.
• Circumvent subscription requirements or trial limits through repeat account creation or other means.
• Use the service in any way that violates applicable laws or regulations.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Subscriptions and Payment

Creator Grader is a paid subscription. Grading is not available without an active subscription or trial. Pro is offered on three billing intervals: weekly, monthly, and annual. The exact price of each interval in your local currency is shown on the purchase screen before you confirm, and that displayed price governs. By subscribing, you authorize a recurring charge to your payment method for the interval you select until you cancel.

Who bills you.Subscriptions purchased inside the Creator Grader iOS app are sold and billed by Apple through your Apple Account, and are governed by Apple's terms in addition to these Terms. Subscriptions purchased on creator-grader.vercel.app are sold and billed by Paddle, which acts as merchant of record.

Free trial. New subscribers receive a 3-day free trial. Payment details are required to start the trial. Unless you cancel before the trial ends, your subscription begins automatically at the end of the third day and your payment method is charged the full price of the interval you selected. You may cancel at any point during the trial at no cost, and you keep access for the remainder of the trial period. Trials are limited to one per person.

Cancellation. You may cancel at any time. Cancellation takes effect at the end of the current billing period and stops all future charges. For an iOS subscription, cancel in your Apple Account subscription settings, reachable from Profile inside the app or from the Settings app on your device; we cannot cancel an Apple subscription on your behalf. For a web subscription, use the management link in your Paddle confirmation email or contact us.

Refunds. For iOS purchases, refunds are determined and issued by Apple under Apple's own policies; request one at reportaproblem.apple.com. For web purchases, refunds are administered by Paddle, our merchant of record, at their discretion, within 14 days of the transaction date. If you are located in the EU, EEA, UK, Turkey, or Israel, you have a statutory right to withdraw and request a refund within 14 days of your purchase. Outside of these cases, web transactions are non-refundable. See Paddle's refund policy at paddle.com/legal/refund-policy for full terms.

We reserve the right to change subscription pricing with 30 days' notice.

7. Our Intellectual Property

Creator Grader, the CLEAR-5 framework, the scoring rubric, and all related technology are proprietary to Creator Grader. Nothing in these Terms grants you any ownership interest in our intellectual property.

You may share your score and feedback results publicly (for example, posting your scorecard on social media). You may not represent the CLEAR-5 framework, the scoring criteria, or the feedback language as your own original work.

8. Termination

You may delete your account at any time. Account deletion removes your profile and grade history from our active systems. Residual data may persist in backups for up to 90 days before permanent deletion.

We may suspend or terminate your account if you violate these Terms, fail to pay for a Pro subscription, or for any other reason at our sole discretion. Where possible, we will give you notice before termination.

9. AI Scoring Disclaimer

Creator Grader's scores are generated by an AI model (Google Gemini) applying our proprietary CLEAR-5 framework. Scores reflect the model's interpretation of the video at the time of analysis.

• Scores and feedback are subjective coaching opinions, not predictions. They do not guarantee any outcome, including views, engagement, follower growth, gifts, brand partnerships, or revenue.
• Scores do not guarantee video performance on any platform.
• Scores do not constitute professional marketing, advertising, legal, or compliance advice.
• Compliance flags generated by Creator Grader (e.g., risk flags for regulated categories) are informational only and are not legal opinions. Consult qualified legal counsel before making compliance decisions.
• AI models can make mistakes. Results should be reviewed by a human before acting on them.

We are not responsible for decisions made based on Creator Grader scores or feedback.

10. Disclaimers and Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by applicable law, Creator Grader's total liability to you for any claims arising out of or related to these Terms or the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $50 USD.

In no event shall Creator Grader be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, loss of goodwill, or business interruption — even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Creator Grader and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) content you upload; (c) your violation of these Terms; or (d) your violation of any third party's rights.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law provisions. Any dispute not resolved informally shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.

Before initiating any legal proceeding, you agree to contact us at support@allegroparktechnologies.com and attempt to resolve the dispute informally for at least 30 days.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will provide notice via email or in-app notification at least 14 days before the changes take effect. Your continued use of Creator Grader after changes take effect constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you may cancel your subscription and stop using the service before the effective date.
